Directive of the Mediation does not develop the procedural aspects of electronic mediation, since today Directive ADR and ODR Regulation applies only to consumption. For this reason, the main objective of the project aims to establish the legal basis for cross-border electronic mediation, from legal, organic and structural perspective in order to serve to complement the future EU regulation about Alternative Dispute Resolution Online (ODR), which is scheduled in 2015 (expected end-date of EMEDEU project). This way thus provide an effective and accessible, fast, lower cost and timeless option that the judicial process, and will directly benefit the governments, the administration of justice, citizens and businesses; without weakening the guarantees of access to justice.
The interest of EMEDEU project is justified in the progression of mediation and its consolidation as one of the most important out-of-court dispute resolution systems at European level, requiring the dissemination and transmission of this relevant event to society, and its optimal legal adapting to the administration of justice, judicial authorities, legal professionals, businesses and citizens. In addition we want to develop a priority line of mediation procedures through its implementation through ICT, under the pre-legislative movements in the EU (European legislation about ODR) and in full association with the EU Framework Programme for Research and Innovation "Horizon 2020".
Mediation saves costs and time and is especially attractive to Governments and to the Administration of justice, because they could reduce their financial burdens due to litigation. For legal professionals is advantageous as it would be a new way to solve cross-border disputes. For academics is a new challenge for research to analyze the advantages and disadvantages of electronic mediation procedures. Citizens find one cheaper and faster new conflict resolution system. Simplification of claims in civil and commercial matters through an electronic out-of-courts procedure will be of particular benefit to companies and SMEs. In addition, EMEDEU project fits perfectly with two strategic lines of the EU Framework Programme for Research and Innovation "Horizon 2020", such as those dedicated to the "SMEs" and the optimization of its resources, and the introduction of new communication and information technologies.
